1. About these Terms

These Terms & Conditions (“Terms”) govern your access to and use of bwsworks.com and your purchase of products or services from BWS Works. By using the Website, creating an account or placing an order, you agree to these Terms to the extent permitted by applicable law.

Nothing in these Terms is intended to remove, restrict or replace any consumer right, warranty, remedy or protection that cannot lawfully be excluded or limited.

• Use the Website only for lawful purposes.

• Do not attempt to interfere with Website security, availability or functionality.

• Do not use the Website to submit fraudulent, misleading, abusive or unlawful information.

• You are responsible for keeping your account credentials confidential and for activity carried out through your account, subject to applicable law.

4. Products, listings and information

We try to make product information accurate and useful. Product pages may include specifications, photographs, availability, pricing, compatibility information and other details. We may correct typographical, specification or pricing errors and update availability. Where a product has configuration options, the final product supplied will correspond to the configuration confirmed with the order.

Actual product photographs may be used where stated. Minor differences in colour, appearance, packaging or manufacturer labelling may occur. A product should not be represented as containing an accessory, feature or component unless the listing states that it is included.

5. New and reclaimed products

5.1 New products

Products identified as new are offered as new goods as described on the relevant product page. The applicable manufacturer or BWS Works warranty, if any, will be stated on the product page.

5.2 Reclaimed hardware

BWS Works uses the term “Reclaimed” as part of its product identity for previously used hardware that has been acquired and prepared for another useful life. Reclaimed hardware may have cosmetic signs of prior use. The actual condition, configuration, included items, and warranty applicable to each product will be stated on the product page.

Reclaimed does not mean that BWS Works manufactured the original hardware. Manufacturer names and model names remain the property of their respective owners.

6. Configurable products

Some products, particularly Mini PCs, may allow you to select RAM and storage configurations. Available choices are limited by compatibility and stock. A configuration option shown as selectable may become unavailable before an order is completed. We may contact you if a selected configuration cannot reasonably be fulfilled and offer an appropriate alternative, cancellation, or refund, as applicable.

For reclaimed Mini PCs, the processor/platform may be fixed to the product listing while RAM and storage are selectable. The product page and order record should identify the configuration supplied.

7. Prices, taxes and availability

Prices are displayed in Indian Rupees unless otherwise stated. Applicable taxes, delivery charges and other charges will be shown at the relevant stage of the purchase process. Stock quantities may be limited, particularly for small workshop batches.

8. Orders and acceptance

Submitting an order constitutes a request to purchase. An order becomes accepted when BWS Works confirms it for fulfilment, subject to applicable payment, availability and verification processes. If an order cannot be fulfilled because of an error, stock issue, payment problem or other legitimate reason, we will contact you and provide an appropriate remedy, including cancellation/refund where applicable.

9. Payments

Payments are processed using the payment methods made available at checkout. The selected payment provider may apply its own terms and privacy policy. BWS Works may use payment-status information to confirm and fulfil orders.

10. Shipping and delivery

Shipping, processing times, delivery areas and delivery charges are described in the Shipping & Delivery Policy and/or at checkout. Configured or workshop-prepared products may require additional preparation time. Any stated delivery date or estimate is subject to courier and other circumstances outside our reasonable control.

11. Returns, refunds and cancellation

Returns, refunds and order cancellation are governed by the BWS Works Returns & Refunds Policy and Cancellation Policy. Those policies form part of these Terms. We will not use these Terms to deny rights that are mandatory under applicable consumer law.

12. Warranty

Where a product carries a BWS Works warranty, the applicable warranty period and coverage are stated on the product page, warranty card and/or Warranty Policy. For reclaimed systems, the standard BWS Works warranty is intended to be six months from the applicable purchase date unless the individual product page states otherwise. Optional extended warranty coverage, where offered, will be described at checkout or on the product page.

Warranty coverage does not automatically cover every type of damage or failure. Exclusions include physical damage, liquid damage, misuse, incorrect power input, unauthorised repair/modification and other exclusions stated in the Warranty Policy, subject always to applicable law.

13. DIY kits and products requiring assembly

Some products, including DIY drone or electronics kits, are supplied for assembly or experimentation. Product pages will identify when assembly is required. Damage caused by incorrect assembly, unsafe use, crashes, misuse, unauthorised modifications or other excluded circumstances may not be covered by a commercial warranty, subject to applicable consumer rights.

14. Product safety and responsible use

Customers are responsible for following applicable manuals, safety instructions and legal requirements for products they purchase. This is particularly important for products involving Li-Po batteries, motors, radio equipment, electrical power, soldering, heat, tools or other potentially hazardous activities. Do not use products outside their stated purpose or operating conditions.

15. Product authenticity and manufacturer relationships

Unless expressly stated, BWS Works is an independent seller/workshop and is not the manufacturer of third-party products sold through the Website. Manufacturer trademarks and product names belong to their respective owners.

16. Intellectual property

The BWS Works name, logo, original website content, original project documentation, original photography, graphics and other original materials are protected by applicable intellectual-property laws. You may not reproduce, modify or commercially exploit BWS Works original materials without permission, except as permitted by law.

17. User accounts

Some Website features may require an account. You are responsible for providing accurate information and maintaining reasonable security over your login credentials. BWS Works may suspend or restrict an account where necessary for security, fraud prevention, legal compliance or other legitimate reasons, subject to applicable law.

18. Reviews, submissions and user content

If the Website allows reviews, photographs, project submissions or other user content, you must not submit content that is unlawful, infringing, abusive, misleading or harmful. By submitting content, you grant BWS Works the permissions reasonably necessary to display and use that content for the purpose for which it was submitted, subject to applicable law and any specific submission terms.

19. Links and third-party services

The Website may contain links, embeds or integrations provided by third parties, such as video, payment, shipping or social-media services. BWS Works is not responsible for third-party websites or services and their separate terms/privacy practices apply to your use of them.

20. Availability of the Website

We aim to keep the Website available and accurate but do not guarantee uninterrupted or error-free operation. Maintenance, updates, hosting issues, network problems and circumstances beyond our reasonable control may affect availability.

21. Limitation of liability

To the maximum extent permitted by applicable law, BWS Works will not be liable for indirect, incidental, special or consequential losses arising from use of the Website or a product, including loss of profits or data, except where such liability cannot lawfully be excluded. Nothing in this clause excludes liability that applicable law does not permit us to exclude.

22. Governing law and jurisdiction

These Terms are governed by the laws of India, subject to mandatory consumer-protection and other applicable laws. Any jurisdiction clause in the final published version should be reviewed against the business’s actual place of establishment and applicable law: [INSERT CONFIRMED JURISDICTION AFTER LEGAL REVIEW].

23. Changes to these Terms

We may update these Terms as the Website, product range, services or legal requirements change. We will post the updated version on the Website with a new ‘Last updated’ date. Changes will not remove rights that have already accrued or rights that cannot lawfully be excluded.
